Night shift differential (NSD) is additional compensation mandated by Article 86 of the Labor Code. Any employee who works between 10:00 PM and 6:00 AM is entitled to a premium on top of their regular hourly wage for each hour worked within that window. It is not a flat daily payment — it applies hour by hour, for only the hours that fall within the 10 PM–6 AM window.
Partial shifts count too
A shift that runs from 8 PM to 4 AM earns NSD only for the 10 PM–4 AM portion — 6 hours. Not for the full 8-hour shift. Many payroll teams apply NSD to the entire shift when only a portion qualifies.
NSD applies to all rank-and-file private sector employees who work within the 10 PM–6 AM window. Employment status does not matter — regular, probationary, casual, project-based, and seasonal employees all qualify if they work night hours.

NSD is applied multiplicatively on top of whatever base rate already applies. It is not a flat addition — it compounds on the OT rate, the holiday rate, or the rest day rate.

Scenario 1
Agent earns ₱25,000/month. Works a fixed 10 PM–6 AM shift (8 hours), Monday to Friday.
Scenario 2
Employee earns ₱142.04/hr. Only 6 hours of the 8-hour shift fall within 10 PM–6 AM.
Scenario 3
Employee earns ₱142.04/hr. Works 2 hours OT on Christmas Day, 11 PM–1 AM.
DOLE requires that night shift differential be computed and recorded separately from regular wages. Payslips must show NSD as a distinct line item — not merged into basic pay or an undifferentiated "premium pay" bucket.
Accurate timekeeping is the foundation. Without timestamps that capture the exact hours worked within the 10 PM–6 AM window, NSD cannot be computed correctly — and you cannot defend the computation during a DOLE inspection.

Does NSD apply if the employee chose to work at night voluntarily?
Yes. The employee's consent to work night hours does not waive their right to NSD. It is a statutory benefit — it cannot be contracted away.
What if the company pays a "night shift allowance" instead?
A separate night shift allowance is acceptable only if it equals or exceeds what the legal NSD computation would produce. If the allowance is less, the difference is still owed.
Does NSD apply to work from home employees on night schedules?
Yes. The 10 PM–6 AM window applies regardless of work location. Remote employees working night hours are entitled to NSD on the same basis as office-based employees.
Is NSD included in 13th month pay computation?
No. Night shift differential is excluded from the basic salary used for 13th month pay computation. It is an additional premium, not part of basic pay.
